Terms and Conditions
1. Scope of Application
These General Terms and Conditions (hereinafter referred to as "GTC") apply to all orders placed by consumers and businesses via the Rugtales online shop. "Consumers" are natural persons who conclude legal transactions primarily for personal purposes (§ 13 BGB); "Businesses" act in the exercise of their commercial or independent professional activity (§ 14 BGB).
By visiting or using our online shop, you agree to these GTC and our Privacy Policy.
2. Seller and Contact Details
IPEK Warenhandelsgesellschaft mbH
Borsteler Chaussee 85, Haus 21
22453 Hamburg, Germany
E-Mail: hello@rugtales.com
Commercial Register: Local Court Hamburg, HRB 60816
VAT ID: DE 812 426 671
Managing Director: Vida ter Hazeborg
These GTC form part of every contract between the seller and the buyer.
3. Customer Account and Access
To use the online shop, including browsing and purchasing products, you may be asked to provide information (e.g., email address, billing, payment, and shipping address). You warrant that all information provided by you is accurate, current, and complete.
You are solely responsible for the security of your login details and for all activities that occur under your account. The account may not be transferred or disclosed to third parties.
4. Product Offering and Contract Conclusion
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to order.
Colour variations between the screen display and the actual product are technically unavoidable. Handmade products such as hand-knotted rugs may exhibit natural irregularities (e.g., abrash, variations in shape and pattern) – these are typical characteristics and do not constitute a defect.
Customers add items to their shopping cart and complete the order. By submitting the order, you are making a binding purchase offer. An automatic confirmation email acknowledges receipt of your order. The actual contract is only concluded upon separate order confirmation or dispatch of the goods.
Rugtales reserves the right to reject orders for objective reasons (e.g., unavailability, incorrect pricing). As each rug is a unique item (quantity 1), an item cannot be reordered after sale.
All product descriptions may be changed at our discretion at any time. We reserve the right to discontinue products at any time.
5. Prices and Payment
All prices stated in the online shop are final prices and include the applicable statutory value-added tax. As the seller participates in the EU OSS (One-Stop-Shop) scheme, the VAT rate of the destination country is applied to deliveries within the EU; the displayed gross price remains unchanged for the buyer. Shipping costs are listed separately and are visible before completing the order.
For deliveries outside the EU, customs duties and import taxes may apply, which are to be borne by the buyer.
Prices, discounts, and promotions may be changed without prior notice. The price valid at the time of order will be listed in the order confirmation.
You agree to provide accurate and complete payment information for all purchases and to update it promptly if it changes.
6. Shipping and Delivery Times
Delivery will be made upon receipt of payment. Processing time: 1–2 working days.
- Germany: 2–5 working days
- EU (Near): 2–8 working days
- EU (Far): 2–8 working days
- Switzerland: 2–8 working days
- Great Britain: 2–8 working days
All delivery times are estimates. We are not responsible for delays caused by shipping service providers, customs clearance, or force majeure. Exact shipping costs per zone can be found on our Shipping & Payment page.
If multiple items are ordered, they will be shipped together with the longest delivery time. Costs incurred due to incorrect address details are borne by the customer.
7. Right of Withdrawal for Consumers
Consumers have a statutory right of withdrawal of 14 days from receipt of the goods without giving any reason, except for custom-made or personalised products.
The seller bears the cost of return shipping – excluding deliveries to Switzerland and Great Britain; in these cases, the buyer bears the return costs.
Withdrawal declarations can be made informally, e.g., by email to hello@rugtales.com.
In addition, the withdrawal can conveniently be initiated via your customer account: open the order → "Request a return". This online option supplements the statutory right of withdrawal but does not replace it – informal notification by email remains possible at any time.
Details are governed by our Return Policy.
8. Warranty and Liability for Defects
Warranty claims are subject to statutory provisions (§§ 434 et seq. BGB).
Natural characteristics of handmade rugs (abrash, slight deviations in size, irregularities in pattern) are expressly not defects and do not give rise to warranty claims.
9. Intellectual Property
All content of the online shop – including texts, images, graphics, logos, videos, and their arrangement – is the property of IPEK Warenhandelsgesellschaft mbH or its licensors and is protected by copyright.
The use of the content is permitted exclusively for your personal, non-commercial use. Without our prior written consent, content may not be reproduced, distributed, modified, made publicly accessible, or otherwise commercially exploited.

10. Relationship with Shopify
The Rugtales online shop is operated on the Shopify platform. All sales and purchases are made directly with Rugtales (IPEK Warenhandelsgesellschaft mbH). Shopify is merely a technical service provider.
By using the online shop, you acknowledge that Shopify is not responsible for any aspects of sales between you and Rugtales, including any breaches, damages, or losses arising from the purchase of products. You release Shopify and its affiliates from all claims arising from or in connection with your purchases and transactions with Rugtales.
11. Data Protection
Information on the collection, processing, and use of personal data can be found in our Privacy Policy.
As the online shop is hosted by Shopify, Shopify collects and processes personal data about your access to and use of the shop to provide and improve its services. For more information, please refer to Shopify's Privacy Policy.
12. Prohibited Use
The online shop may only be used for lawful purposes. In particular, it is prohibited to:
- use the shop for illegal or fraudulent purposes;
- reproduce, extract, or automatically retrieve content from the shop without authorisation (scraping, bots, crawlers);
- transmit false or misleading information;
- upload viruses, malware, or other harmful content;
- circumvent or manipulate the shop's security mechanisms.
We reserve the right to block access to the shop in case of violations.
13. Limitation of Liability
Rugtales is liable without limitation for damages arising from injury to life, body, or health, as well as for damages caused intentionally or by gross negligence.
In the event of a slightly negligent breach of essential contractual obligations (cardinal duties), liability is limited to the contractually typical, foreseeable damage. In all other respects, liability for slight negligence is excluded.
The above limitations of liability do not apply to claims under the Product Liability Act or for any warranties assumed.
We do not guarantee the accuracy, completeness, or timeliness of the content in the online shop, insofar as it is not part of the contract.
14. Errors and Inaccuracies
Information in the online shop may occasionally contain typographical errors, inaccuracies, or omissions that may relate to product descriptions, prices, shipping costs, or availability. We reserve the right to correct such errors at any time and to cancel orders if information was incorrect – even after your order has been placed.
15. External Links and Third Parties
The online shop may contain links to third-party websites. We are not responsible for their content, privacy practices, or availability. Accessing external sites is at your own risk.
16. Changes to the GTC
The current version of the GTC can be viewed on this page. We reserve the right to update, change, or supplement these GTC at any time. We will inform you of significant changes in accordance with legal requirements. Continued use of the online shop after publication of changes constitutes acceptance.
17. Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers with their habitual residence in the EU, mandatory consumer protection provisions of the country of residence remain unaffected.
For businesses, Hamburg is agreed as the place of jurisdiction.
Should individual provisions of these GTC be invalid, the remaining provisions shall remain unaffected (severability clause).
Failure to exercise a right under these GTC does not constitute a waiver of that right.
